Authorization of New York State Dedicated Federal Transportation 2 Operating Agreement -Tompkins County

WHEREAS, This agreement identifies the party responsible for administration, and establishes the method or
4 provision for funding, of mass transportation operating assistance to support public transportation system in Tompkins
5 County, and

7 WHEREAS, the New York State Department of Transportation (NYSDOT) desires to execute a Dedicated
8 Federal Transportation Operating Agreement (C005998) with Tompkins County to simplify the process of State
9 reimbursement of expenses for public transportation operating expenses, and
10
11 WHEREAS, Section 5311 of Title 49, United States Code, provides federal financial assistance for public
12 transportation in rural and small urban areas by way of a formula grant program to be administered by the States, and
13
14 WHEREAS, NYSDOT is authorized by Section 14 of the Transportation Law to assist in the operation of
15 transportation facilities and services in the State, including mass transit facilities and services, and
16
17 WHEREAS, the Contractor may make application annually to NYSDOT for such federal aid for operating
18 assistance for the Project, and
19
20 WHEREAS, annual Project Applications are submitted to NYSDOT for approval and approved annual Project
21 Applications are included in the State’s annual 5311 program submitted to the Federal Transit Administration for
22 approval for federal financial assistance, and
23
24 WHEREAS, NYSDOT and Tompkins County desire to enter into a continuing agreement for the receipt by
25 Tompkins County of federal operating assistance payments pursuant to said annual Project Applications, provided that
26 such federal funding is made available by the Federal Transit Administration and the State, now therefore be it
27
28 RESOLVED, on recommendation of the Facilities and Infrastructure Committee, That the Tompkins County
29 Legislature authorizes the County Contracts Coordinator to execute the New York State Dedicated Federal
30 Transportation Operating Agreement for the contract period January 1, 2023 through March 31, 2029
